Terms and Conditions

RENTAL AGREEMENT TERMS AND CONDITIONS:  Update Version Feb.2024

________ VERY IMPORTANT – PET POLICY: BISON VIEW LODGE IS AN ALLERGY FRIENDLY,  “NO PET” FACILITY THAT MEETS THE NEEDS OF OUR CUSTOMERS AND OWNERS WITH SEVERE ALLERGIC REACTIONS TO PET DANDER. BY SIGNING THIS AGREEMENT, YOU AUTHORIZE BISON VIEW LODGE LLC TO CHARGE THE CREDIT CARD USED FOR YOUR RESERVATION A PET FEE OF $500 PER ANIMAL IDENTIFIED ON OUR SECURITY CAMERAS. 

 

REGISTERING GUEST (ALSO DEFINED AS GUEST OR GUEST(S): The person signing this agreement shall be liable for all acts of the family, invitees, employees, or other persons invited onto the property. Guests may not sublet or assign this rental agreement. Guests shall abide by the Bison View House Rules listed below.  By signing this agreement, the primary guest/signor understands that their invited guest(s) shall not bring any pets or other animals onto the property per policy above. No guests will be permitted on property except those included on the rental agreement guest list due 14 days prior to arrival. 

 

RENTAL AGE PROVISION:  For corporate retreats, the age provision is waived. Guests making reservations must be at least 26 years old and by submitting their reservation they are confirming that they are 26 years old or older and they will be present at the property. Guests shall provide a guest list with ages and phone numbers at least 14 days prior to arrival. A photo ID is required for age verification.No college/university Greek and/or other fraternity/sorority organizations may rent the facility. 

 

Review and acceptance of the following conditions is made part of this rental agreement and is required before a reservation will be issued. Bison View Lodge LLC requires this agreement to be executed within 48 hours in order to hold your reservation. This Cabin Rental Agreement is a legally binding agreement between the Booking Party, its Guests, & Bison View Lodge LLC. This reservation contract binds you to a specific period of time.  

 

If you are found to exceed the maximum occupancy of your cabin it will be considered a breach of contract and may result in immediate eviction with no refunds or rebates. 

 

EVENTS & WEDDING DISCLOSURE:  Special pricing exists for weddings and other event related activities. Please see our Wedding & Event Addendum for information. 

 

AREA & ROAD DISCLOSURE: All roads leading to the cabin are paved with the exception of the last 2.9 miles. You will travel a gravel road maintained by the US Forestry Service. When traveling this road, you may encounter potholes and ruts from mountain water runoff. We regularly observe standard passenger cars on the gravel road, but in accordance with the US Forestry Service,  Bison View Lodge LLC recommends that only trucks and higher clearance vehicles (SUVs for example) travel the road. Bison View Lodge LLC is not responsible for damage to vehicles or accidents due to the gravel road. Bison View Lodge LLC is not liable for the condition of the road.  NO REFUNDS will be offered because of road conditions.  However, it is traveled daily by passenger cars, trucks, and SUVs. Please make note of directions when they are sent to you 7 days prior to your arrival. 

 

RATE DISCLOSURE INFORMATION: Rates are subject to change without notice depending on demand or other market factors.  Rates cannot change once booking is confirmed and deposit paid.  Pricing is based on specific occupancy and number of guests. 

 

When renting the entire Bison View Lodge Retreat, pricing is fixed up to 45 guests. For every guest over 45, there is an additional fee of $50/per person per night plus tax. Maximum occupancy for overnight accommodations is 58.  Bison View Lodge does not permit additional guests over 58 overnight. 

 

FUTURE EXPANSION: We are constantly improving and growing the Bison View Lodge property. This reservation gives you  access to the properties indicated above. Housing offerings that become available through expansion are not included in this agreement. Expansion properties can be quoted at an additional cost once they are completed.

 

CANCELLATION POLICIES: 

 

PLATFORM CANCELLATION POLICY: The cancellation policy for AirBnB supersedes supersedes this agreement unless rental is a wedding or takes place over the following major American holidays (Memorial Day, Labor Day, Independence Day, Thanksgiving, Christmas Eve, Christmas Day, New Years Eve, New Years Day). Please see Holiday Cancellation Policy below. On VRBO cancellations, a 10% fee will be assessed to cover administrative fees and credit card processing that were incurred by Bison View Lodge as a result of your booking with a credit card.  Customers will need to reach out to the platforms if the “guest fee” charged by the platforms (AirBnB, VRBO, etc) is not refunded as those funds are not paid to Bison View Lodge. 

 

DIRECT BOOKING CANCELLATION POLICY: Cancellations made more than 60 days prior to check-in date will receive a full refund less a 10% cancellation fee to cover credit card processing fees and administrative expenses incurred due to the cancellation. Cancellations made 45 to 60 days prior will receive a 50% refund, within 45 days of check-in date, the trip is non-refundable. Weddings require a 50% non-refundable deposit. 

 

MAJOR HOLIDAY CANCELLATION POLICY: Major Holidays are defined as Memorial Day, Labor Day, Independence Day (July 4), Thanksgiving, Christmas Eve (December 24), Christmas Day (December 25), New Years Eve (December 31), and New Years Day (January 1). Guests may not check in or out on a major holiday. Guests shall receive a 90% refund if cancellation occurs 60 days or more before the major holiday. There will be no refund within 60 days of the above “MAJOR HOLIDAYS”. 

 

REFUNDS: We strive to deliver a wonderful, memory making experience for our guests. We will make every reasonable effort to correct any problem that arises during your stay in a timely manner. There should be no expectation of refund, and there will be no refund because you are disappointed with the property you have chosen to rent or in the event that something associated with the property is not working to your satisfaction.  Bison View Lodge LLC will not be liable under any circumstances to refund any unused portion of booked accommodations or services. Bison View Lodge has the right to send a check as opposed to a credit card reimbursement. 

 

TRAVEL INSURANCE: We highly recommend guests purchase travel insurance to protect against financial loss from unforeseen conditions that may lead to cancellation (ex: sickness or injury, job loss or relocation, severe weather, revoked military leave, etc)  A reputable website to shop for trip insurance is: https://www.insuremytrip.com/

 

POWER/ WEATHER RELATED CANCELATION: Bison View Lodge LLC is not required to issue refunds due to acts of nature such as: weather, road conditions, snow conditions, power outages or forest fires. However, Bison View Lodge LLC does understand acts of nature do occur and in good faith will look at each scenario on a case by case basis to determine if reimbursements are warranted. 

 

ADDITIONAL SERVICES: Please contact the host if you’re interested in additional services such as a personal chef, caterer, custom transportation, tours or excursions, hiking/fishing guides, or whatever your imagination can dream up. 

 

SECURITY DEPOSIT: If you haven’t purchased trip insurance, a $1,000 security deposit is required to protect against damages to and/or loss of items from the Property. The deposit will be held in the Bison View Lodge general bank account and will be returned, minus deductions, not later than 14 calendar days after the termination of the agreement. Bison View Lodge reserves the right to use its discretion as to what is considered accidental vs intentional or negligence on the part of the guest. The damage waiver fee does not apply to our cleaning fee, which is explained below. Guests agree to call Bison View Lodge hosts if any damages or defects are noticed upon check-in. 

 

We will provide you with a written statement explaining any deductions. Deductions can be made for the following reasons: to repair or replace anything that is damaged or missing; to replace keys; additional cleaning expense or to clean excessive dirt (i.e. dishes/pans/appliances left with excessive food on them, stained carpets, furniture, walls, appliances, etc.) and to return the unit, and the things in it, back to the condition when you first arrived. If your deposit is not enough to cover all the damages and costs, you agree to pay the extra amount, and you authorize us to charge the credit card provided.

 

DOWN PAYMENT/ PAYMENT: DIRECT BOOKINGS: A reservation can be made with a 50% down payment paid by credit card, cashier’s check, or bank wire when the reservation is made. We do not accept ACH transactions. The remaining balance, along with the $1,000 security deposit is due and charged 30 days prior to the scheduled arrival date. If Guest wishes remaining balances to be made through another method or credit card, Guest must contact Bison View Lodge LLC before balance payment is due with a different card than the one on file. If we do not hear from you, we will charge the balance to the original credit card on file. The credit card must have an expiration date that extends beyond your stay. If a reservation is made less than 30 days prior to arrival, full payment is due when the reservation is made, and no refunds will be given. 

 

If the booking party prefers, a bank wire or cashier’s check can be accepted via overnight delivery. If payment has not been received within 48 hours of booking, then your booking dates will be released back to the public. If wiring funds, please contact us for wiring instructions. 

 

CLEANING FEE(s): Cleaning a property of this magnitude and making it beautiful for you is not a simple task. The cleaning fee is used to pay our housekeepers a liveable wage and to find the best housekeepers in the area to serve our guests. Properties have been cleaned and inspected prior to your arrival.  Service animals are subject to an additional deep cleaning fee of $500 and must be disclosed in writing prior to arrival. 

 

LINENS & TOWELS: Bath towels, sheets, pillows and blankets/duvet cover  are professionally laundered prior to your stay and there for your use during your stay.  Please do not use white bath towels outside for the hot tub. We have provided hot tub towels for you in the laundry areas of the cabin and the lodge. Extra sheets and towels are provided if you are staying a week or longer (otherwise one set per bed is provided where laundry facilities are available). 

 

PRIVATE CHEFS & 3RD PARTY VENDORS SERVING GUESTS:  Bison View Lodge only allows our preferred caterers and personal chefs on the property. They have been vetted and know the property well. They understand how best to serve our guests.  If we approve a private chef or caterer not on our list, you agree to provide us with their contact information when you hire them.  We do charge a $250 vendor fee to caterers and personal chefs not on our list.  They are to leave the property as they found it, which means all items and appliances used in the preparation of food must be cleaned and returned to its original location. 3rd party vendors are required to sign a vendor waiver. 

 

HOLDOVER, ABANDONED POSSESSIONS AND SERVICE OF NOTICES:

If you stay in the unit, without written permission, after the Rental Agreement has ended, you will be a holdover tenant and will be liable for twice the daily rent for each day you are a holdover tenant. 

 

If you leave personal property, which we determine to be of value, we will contact you. After 3 days, if you do not respond, we may dispose of the items, sell them, or donate them to a local charitable organization. If an item needs to be returned to you, you must pay any shipping charges plus a $50 handling charge to Bison View Lodge LLC. 

 

NOTICE GIVEN:  If we have to give any notice to you, we will attempt to serve it to the Signatory of the agreement. If we cannot contact you, we may serve notice to any occupant.  By serving one of you, we have given notice to all. If we cannot deliver a notice to anyone, we may post the notice in an obvious place in or on the property. If you booked your trip on a platform such as AirBnB or VRBO, we will serve notice through the app. 

 

INSURANCE:  You understand that our insurance does not cover your belongings or damage that you cause. You agree that we are not responsible for any loss or damage during the term of the rental agreement. You agree to carry insurance covering all of your personal property located in the unit or bear full responsibility for its damage including loss/damage from fire, water, theft, or any cause.

 

CAMERA & NOISE SENSOR DISCLOSURE: There is an exterior security surveillance system to keep watch over the property. They will be operational during your stay. Cameras are located on the exterior of the lodge, barn,cabin, any entry/exit, and garage. We DO NOT have cameras inside the residences. The garage/trash collection area has an interior camera. Noise sensors only record the sound levels, not actual noise itself. They have been set to notify us if the decibel levels are high enough to disturb our neighbors on the mountain. 

 

BASIC SUPPLIES: A starter supply of expendable supplies such as toilet paper, paper towels, makeup wipes, and hand soap is provided; please bring additional if you feel this will not be adequate. We do not provide body washes or shampoo. Basic cleaning supplies (brooms, mops, toilet bowl brushes, all surface cleaner)  are stocked if you choose to do light housekeeping during your stay. Housekeeping is not provided unless previously arranged. The properties come fully equipped with dishes, utensils, basic spices, and cooking oils. 

 

WASHERS & DRYERS: The Main Lodge and Hilltop Cabin have its own washer and dryer. Please do not overload those appliances with heavier loads than normal.  Please allow us to wash the cabin’s linens unless you need clean linens during your stay. The Barn does not have laundry facilities.

 

FURNISHINGS/FURNITURE  Do not move interior furniture.  All furnishings/furniture in the cabin are in place as the owners wish them. Guests agree to pay not less than $150 if furniture is rearranged in such a manner that results in cleaning services being delayed. Guest further acknowledges that furniture/furnishings are replaced periodically as needed and as a result, the pictures on the website or booking platform may not be an exact replica of what is actually in the cabin.

 

PLUMBING & SEPTIC SYSTEMS: All Bison View Lodge buildings are on a septic system. ONLY FLUSH TOILET PAPER in the toilets. All toilets are tested prior to arrival. If a foreign object is found in the toilets that causes us to require a professional plumber, the guest agrees to pay for the plumbing invoice.  Please DO NOT pour grease down the drain. No parking or driving on grass, it will damage the septic systems. 

 

INTERNET:   The properties are equipped with WIFI internet service from Windstream/Kinetic. Speeds are typically 35 to 60 megabytes per second. 

 

PHONE/CELLULAR SIGNAL: Cell phone coverage varies by carrier and signal strength may be poor or non-existent in some parts of the property.  We recommend making calls via wifi when possible. 

 

TELEVISIONS: Bison View Lodge LLC has equipped televisions over 40” with ROKU devices to allow streaming from your favorite subscription services. For more information, please visit Roku’s website. Bison View Lodge does not provide cable television. 

 

Bison View Lodge does not guarantee the reliability of any 3rd party services used for internet, cellular phone companies, or utility providers. 

 

FIREPLACES & FIRE PITS: Bison View Lodge sits in the middle of the US Forest and fire is the forest’s primary enemy. We want you to enjoy our fireplaces and firepits, but please do so with the utmost of care. DO NOT LEAVE BURNING OR SMOLDERING FIRES UNATTENDED. Do not use any type of propellant such as lighter fluid or gasoline. Candles are not permitted on the property. We provide two bundles of firewood and “Fatwood” starters. Additional firewood can be purchased on site or you may bring your own. LED candles are provided in each cabin. Do not burn pine wood in fireplaces. 

 

CHECK-IN TIME: Check in is from 4pm or later.  No Check-In or Check-Out allowed on major holidays without prior approval (Memorial Day, Labor Day, Independence Day, Thanksgiving Day, Christmas Eve, Christmas Day or New Year’s Day). Properties have been cleaned and inspected prior to Guests’ arrival.  

 

EARLY CHECK-IN:  Early check-in fees, when available, are $149 plus tax (per 3 hour block)  for individual cabin rentals and $499 plus tax (per 3 hour block) for a full retreat booking.   EX) If you wanted an early check-in for 10am, 6 hours early, your early check-in fee would be $298 plus tax for an individual cabin, and $998 plus tax for full retreat rental.  Please call or email 48-72 hours prior to your trip to see if the cleaning schedule and booking calendar can accommodate an early check-in. 

 

CHECK-OUT TIME: Check out is at 10:00am. If you have not arranged for a late check out, you may be charged $100 for each hour beyond 10 am you are still on the property. 

 

LATE CHECK-OUT:  Depending on calendar/cleaning availability, a late check-out may be arranged by contacting the host at least 48-72 hours prior to check out. Late check-out fees are $149 (per 3 hour block)  for individual cabin rentals and $499 (per 3 hour block)  for a full retreat booking.  Please call or email 48 hours prior to your trip to see if the cleaning schedule can accommodate a late check-out. 

 

UPON ARRIVAL: Walk through all cabins/lodges. If there are concerns or issues with the property, please immediately contact our office (404-777-6711) or reach out through the app platform of your booking. 

 

CHECK-OUT PROPERTY CONDITION: The property shall be in the same condition upon departure as at check-in, with the exception of bedding and linens. There will be an extra cleaning charge of $150 placed on the credit card on file if pots, pans, smoker, ovens, or stoves are left unclean with food stuck on/in them. Guests may cook in areas specifically designated for cooking. Guests must immediately notify Owner or agent of fire or other damage to property. 

 

DRIVING DIRECTIONS: Directions will be emailed to Registered Guest (7) days or more prior to your arrival date providing the reservation has been paid in full, a copy of drivers license submitted,  and a complete guest list provided. Please PRINT directions as cell service is not always available in the mountains.  

 PARKING: DO NOT PARK IN GRASS AS SEPTIC TANK DAMAGE WILL OCCUR. A maximum of 30 vehicles may be parked in the concrete areas. Any guest who parks on the grass will be responsible for paying for a septic tank inspection ($250) and all related repairs. 

 

MAINTENANCE STAFF & VENDORS – Guests acknowledge, understand, and agree that managers, caretakers, employees, and subcontractors of Bison View Lodge LLC reserve the right to enter the grounds at any time to make general repairs, perform daily and weekly maintenance & inspections. Our caretaker/operations manager is on site most days working on the property. The hours contractors may enter the property are between 9am and 5pm Monday through Friday. We will try and notify you in advance of any long term projects. NO REFUNDS OR REBATES will be offered for inconveniences due to but not limited to; construction, construction noise, landscaping, road repair, and maintenance. 

 

SECURITY & SAFETY RISKS: ALWAYS LOCK DOORS AND WINDOWS WHEN YOU LEAVE THE CABIN! When you rent the cabin, you assume responsibility for it and its contents, as well as your personal property. Always lock the doors and windows when you leave the cabin. Guests are responsible for lost key replacement costs. Children are welcome, but there are conditions in and around the home that may pose hazardous to them, as well as to adults, including, but not limited to: the land, the creek, steep land, open stairways, narrow stairways,  wildlife, icy/snowy surfaces, fireplaces, retaining walls, barbed wire, protruding nails, rough/splintery wood, and wildlife. Bison View Lodge does not assume any responsibility for injuries resulting from your failure to use due caution. Children must be supervised at all times. Candles are not allowed due to fire hazard except citronella candles in buckets outside. Battery operated emergency candles are supplied in case of power outage.

 

ALCOHOL: No drinking of alcoholic beverages by persons under the legal age of twenty-one (21) is allowed. Guests agree that if Guests are arrested for underage drinking at rental properties or if Bison View Lodge LLC observes Guests under the legal age of twenty-one (21) drinking alcoholic beverages, this Agreement/Contract may be unilaterally terminated by the owner and Guests will be evicted with no refund or rebate. Illegal drug use is strictly prohibited. 

 

PROPERTY USE RESTRICTIONS: Use of premises shall not be such as to disturb or offend neighbors or residents, including but not limited to; loud parties, excessive speeding through neighborhoods, riding of ATV’s or Off Road Motorcycles/Dirt Bikes on property, excessive noise and/or obnoxious behavior.  Discharging of Firearms, BB/Pellet Guns, Paintball Guns, Potato Cannons, or Fireworks, is STRICTLY prohibited. Bison View Lodge LLC reserves the right to terminate this Agreement/Contract and to demand that disruptive Guests vacate the premises, thereby forfeiting all monies to Bison View Lodge LLC.

 

SMOKING: Smoking, vaping, or the use of any illegal drug is NOT permitted inside any Bison View Lodge building. Vaping and cigarette smoking is permitted outside as long as butts and ashes are not left behind. Discard all extinguished cigarette butts and ashes in the provided ash buckets

 

QUIET HOURS: Quiet hours are 10pm to 8am.  Bison View Lodge LLC has the prerogative to terminate this Agreement/Contract and to demand that disruptive Guests vacate the premises, thereby forfeiting all monies paid to Bison View Lodge LLC. Quiet hours are 10pm to 8am. 

 

HOT TUBS – Guests may not add any objects or chemicals to the hot tubs or pools except what is provided to them at check-in. Guests agree to pay not less than $250, if the hot tub or pool has been compromised in such a manner that results in cleaning services being delayed. Hot tubs have been properly  sanitized and inspected prior to Guests arrival. Guests agree to pay an additional charge of $50 if Guests request an additional cleaning of the hot tub during stay.  Guests understand that hot tub & pool usage is at their own risk and guests agree they will not hold Bison View Lodge LLC or Property Owner responsible for any injury or reaction from its use.  It is absolutely forbidden for children to be in the hot tub or pool without a responsible adult present.  Pool/Hot Tub Rules are posted at the property and guests agree to adhere to them. 

 

Guest acknowledges that the owner would not rent the property unless the Guest accepted these conditions.

 

FIREPLACES: Fireplaces with synthetic logs are decorative only and do not light. All wood burning fireplaces have a flue that will be closed upon your arrival. When burning fires, be sure to open the flue prior to lighting the fire. Indoor fireplace use is NOT PERMITTED when air conditioning is being used.

 

GRILLS – Each property is equipped with a Traeger pellet grill and charcoal grill.  Grills have been filled with pellets to your arrival. Each cabin also has a Weber charcoal grill for your use. We DO NOT provide charcoal or propane. 

 

WILDLIFE:  Depending upon the time of year you may encounter black bears, deer, turkey, ladybugs, carpenter bees, hornets, wasps, scorpions, poisonous snakes, ticks, ants, chiggers, wild hogs, squirrels, mice,  etc.  Guests are encouraged to dress accordingly and to bring insect repellent for outdoor activities. NO REFUNDS or discounts will be given because you have encountered one of these animals/pests. 

 

TRASH: Place trash in the collection area found in the trash building between the Main Lodge and the Barn. Do not leave trash outside. Bears can smell it from miles away. 

 

EMERGENCIES/ MAINTENANCE: In the event of a problem getting in the cabin or if there are problems with condition or functionality of the cabin, please immediately contact the Bison View Lodge office at (404)777-6711, or reach out through the app you booked on. If it is a life threatening emergency, please call 911. Otherwise, you will be contacted during normal business hours.

 

Like your own home, things will sometimes break or leak without notice. We will make every reasonable effort to correct any problem that arises in a timely manner.  No warranties are expressed with regards to heat, air conditioning, electricity, water, any appliances, cable, satellite, television, telephones, electronics, gas logs, grills, electric gates, roof leaks, etc. NO REFUNDS OR REBATES will be given if something breaks. 

 

Should a repair person make a call to repair or replace a unit that is found to be in non-working order and the problem was due to Guests oversight, neglect or misuse, Guests agree that the repair call costs may be billed to the Guests credit card on file.

 

EXPEDITED EVICTION: A material breach of this Agreement by Guests, which, in the sole determination of Bison View Lodge LLC, results in damage to the Premises, personal injury to Guests or others, a breach of the peace, a nuisance to others, or a violation of criminal law or local code, shall be grounds for termination of Guests tenancy.  Violation of any of the rules contained herein will result in IMMEDIATE EVICTION and forfeiture of rent and security deposit.  If the tenancy created here is for 30 days or less, the expedited eviction procedures set forth in the Cabins Act will apply.  Guest(s) may be evicted under such procedures if Guest(s): (I) hold over in possession after Guest(s) tenancy has expired; (II) commit a material breach of any provision of this Agreement that according to its terms would result in the termination of Guest(s) tenancy; (III) fail to pay rent as required by this Agreement, or (IV) have obtained possession of the Premises by fraud or misrepresentation. Any reservation made under false pretenses will result in forfeiture of advance payments and the party will not be permitted to check-in. 

 

DISPUTES: This Agreement/Contract shall be governed by and interpreted in accordance with the laws of the State of Georgia and be treated as though it were executed in the County of White, State of Georgia.  Any action relating to this Agreement/Contract shall be instituted and prosecuted only in the White County Superior Court, Cleveland, Georgia. Guests specifically consent to such jurisdiction and to extraterritorial service of process. 

 

PROPERTY DAMAGE: Guests acknowledge, understand, and agree that Guests shall be solely responsible for any property damage, accident or injury to any person or loss sustained by any person, including loss of money, jewelry, and other items of personal property, arising out of or in any way related to Guests use of the premises or the items of personal property provided by Bison View Lodge LLC, at Guests request.  Guests shall inspect and be familiar with proper use and application of such items the lodge may provide prior to using them.  Guests hereby agree to INDEMNIFY and hold Bison View Lodge LLC, its employees, owners and officers; and/or Homeowners harmless from any and all claims including those of third parties, arising out of or in any way related to Guests use of premises or the items of personal property provided therein. Guests hereby agree to hold Bison View Lodge LLC, and/or homeowner, employees and officers harmless and to indemnify same against any and all claims which may arise during and after the course of rental as a consequence of any acts or omissions of Bison View Lodge LLC, and/or cabin owner, employees and officers.  Guests assume the risk of injury or other losses relating to any recreational activities and will hold owner and Bison View Lodge LLC, harmless with respect there to.

 

INTERNET ACCESS TERMS OF USE: Bison View Lodge LLC, and Cabin Owners/Account Holder as part of this rental offers access to internet service provided through an account with Kinetic.  The undersigned renter, requesting and accepting the inclusion of this access as part of the rental package, agrees to abide by the provisions of the Acceptable Use Policy and Terms of Service of Kinetic which may be viewed at https://www.windstream.com/about/legal/terms-and-conditions

 

  1. Bison View Lodge LLC,  is not responsible for degraded or interrupted services.  All information you receive from or through the account is provided “as-is” “as available” and all warranties, express or implied are disclaimed.  If you are dissatisfied with the internet access, you may immediately discontinue use, such being your sole remedy, and understand that and agree that access to this service would not be made available to you without these limitations.  
  2. Access is furnished subject to the condition that it will not be used for unlawful purpose.        
  3. You certify that minors use of the service during your rental period shall be deemed to be with your express permission. and that as the signer on this agreement, you are solely responsible for the actions of the minor in using this account. 
  4. You further understand and agree that permission to use passwords or access codes to access this internet account/service terminates upon termination of your rental contract.    

INDEMNIFICATION & HOLD HARMLESS: While Bison View Lodge LLC and its Property Owners strive to maintain Vacation Properties in the finest condition, no guarantees are expressed or implied regarding suitability or for any particular purpose. All Guest(s) and their invitees use the Vacation Property structures and premises at their own risk. Bison View Lodge LLC and its Property Owners shall not be held liable or otherwise responsible in any way for injury to any Guest and/or their invitees that is caused or permitted to be caused by the intentional or unintentional acts of said Guest(s) and/or invitees, or by the failure of structures, appliances, (including hot tubs and BBQs) furnishings, and/or other equipment, whether by malfunction, misuse, acts of God/nature, and/or are otherwise naturally occurring. No guarantees are expressed or implied as to the suitability of utilities and other services provided to the Vacation Properties and adjacent structures and premises. No guarantees are expressed nor implied regarding the suitability/compatibility of materials utilized in the construction of the Vacation Property and/or its contents. Bison View Lodge LLC and its Property Owners shall not be held liable nor otherwise responsible in any way for allergic reactions to Guest(s) or invitees, caused or permitted to be caused by materials utilized in the manufacture of the Vacation Property and/or its contents, nor from mold and/or airborne spores, nor from pet/animal allergens, nor from chemical agents including, but not limited to: latex, appliances, linens, cleaning products, carpeting, utensils, fixtures, hot tubs, and/or other equipment. By written or electronic endorsement of this Agreement, Guest(s) and invitees hereby agree to forever hold-harmless and indemnify Bison View Lodge, LLC and its Property Owners from and against all claims, demands, loss, liability/responsibility of any kind and character, including cost of defense, arising out of or in any way connected with the Guest(s) use of the property.

 

Some activities in which guests engage are especially dangerous and include hiking, cycling, the use of ATVs and side by side, tubing, driving on mountain roads,  fishing, boating, swimming, and mountain climbing. This list is not all-inclusive, but indicates some of the hazards of vacationing in the North Georgia mountains. 

 

Guests may also encounter the following risks: slippery floors and stairs – especially when wet,  rough sawn cedar siding and walls on exterior and interior of cabins that can cause splinters, railings with spaces between rails (dangerous for little children), unfenced hot tubs, faulty electrical or plumbing systems unknown to Bison View Lodge LLC, hot BBQ grills, clean/clear sliding glass doors, random nail pops on exterior wood, and narrow/hazardous stairs or pathways, construction materials or objects  that may be on site.   Therefore, each guest agrees that he/she is voluntarily participating in any and all activities, risks, and use of the accommodations, and hereby assumes all risk of injury, illness, damage or loss to person and property that might result, including, without limitation, any loss or theft of personal property. 

 

We reserve the right to cancel or rescind any rental agreement if it is found that the Guests are conducting any unlawful activities, not abiding by the House Rules, or  have made any misrepresentations about the nature or size/use of the group, or any other misrepresentations or any other way in breach of the rental agreement.

 

 

 

BISON VIEW LODGE HOUSE RULES

 

LEAVE IT AS YOU FOUND IT:  You are renting a property that individual owners enjoy and use. We ask that you leave the property as you found it. If you don’t, we assume you’re OK with us charging you to have our cleaning team return the property to its original condition, including the repair of any damage. 

 

DOORS MUST REMAIN CLOSED AT ALL TIMES:  All doors should be closed & latched securely to keep bears, birds, snakes, and other wildlife out of cabins. Birds can fly in very easily and they leave a big mess. Bears will also attempt to enter a property if doors are left ajar or open. Please do not open doors labeled “EMERGENCY EXIT ONLY”. 

 

TOILETS: The lodge is on a septic system. Only flush toilet paper, nothing else, not even septic approved wipes. We test every toilet before your visit. 

 

PARKING: CONCRETE ONLY. NO DRIVING OR PARKING ON THE GRASS with any vehicle. The septic system is complex, and there are 4 of them on the property. Driving on the grass is guaranteed to damage the systems, making it a very expensive vacation. 

 

TRASH: ALL TRASH MUST BE BAGGED AND KEPT INDOORS. Bears can smell it from miles away. Place trash in the collection area found in the Garage between the Main Lodge and the Barn. 

 

CAMERA DISCLOSURE:  Security cameras are located on the exterior of all properties. We DO NOT have cameras inside the property. 

 

DO NOT MOVE FURNITURE IN LODGE OR HILLTOP CABIN: Our floors are pine and easily scratched. Please do not move any furniture in these two cabins. 

 

GUNS: We get it, you’re up here in the middle of nowhere hanging out with the bears. However, we do have a neighbor about ½ mile in the woods. There are many places to shoot guns in White County, Bison View Lodge isn’t one of them. 

 

FIREWORKS ARE PROHIBITED:  Fire is the enemy of the forest and we don’t want you to be the reason the North Georgia Mountains catch on fire. Smokey the Bear would hunt you down.  It would take a firetruck 30 to 45 minutes to arrive, by that time, any fire would be out of control. 

 

PETS: No pets of any kind are allowed on property. 

 

ATV’S, SXS, & OTHER VEHICLES: Please keep all vehicles on concrete or gravel. If there’s mud on the driveway from your vehicles being “off-road”, it’s your responsibility to clean it off. 

 

HOT TUBS: Follow signs posted. No food or glass is allowed in hot tubs. No children in hot tubs without an adult present. 

 

OWNERS CLOSETS: The locked closets contain the personal property of the Owners and are not to be opened.

 

LEAK DETECTION, ROUTERS, MESH WIFI SYSTEMS: There are safety systems on the property. Leak detection sensors are white “puck like” devices near water sources. They are designed to alert us of any issues and may turn the water supply off. If this happens, please notify us immediately and we can troubleshoot any issues with you. Please leave our property as you found it:  You are renting a property that individual owners enjoy and use. We ask that you leave the property as you found it with the exception of linens and bedding. 

 

  • Wash and put away all dishes, pots/pans, and anything else you used during your stay to its original location. 
  • Furniture: Indoor furniture is not to be moved. Please return outdoor furniture as you found it. Use pictures found online as a guide. 
  • Clean the grill with a wire brush or pumice pad if you used it.
  • Leave used towels/washcloths in the shower or tub. Please do not leave wet towels or washcloths on wood floors. 
  • Please leave any beds used during your stay “un-made” on the day of check-out to let us know that the bed was used.  Unused beds can stay made. 
  • Empty refrigerator. Any extra food or supplies that you want to leave may be left in the fridge or on the kitchen counter and will be donated if possible.
  • Bag garbage/trash and place it in the trash collection area.
  • Close and lock all windows and doors
